  Took our deposit, never did the work

  “J.A.G. Landscaping took a $900 deposit from us, and then never returned to perform the work. We have never been able to recover our $900 deposit from Joseph A. Guarino, Pres. & Treasurer of J.A.G. Landscaping.
  
  On or about March 25th, 1998, Joseph A. Guarino came to our property in Medford, MA, for the purpose of providing an estimate for putting down a block patio between our house and garage. We finally received his estimate about 2 weeks later, on or about April 7th, 1998.
  
  The estimate was for $1,585.00, and Joseph Guarino asked us for a down payment of $900.00 with the balance to paid upon completion. When I stated my reservations about providing such a large deposit, Mr. Guarino assured me that that's not the way we do business, and that I had nothing to worry about.
  
  Joseph Guarino told me that he would plan to begin on Monday, April 27th, and that the job would take two days to complete. I provided him our check # 1211, in the amount of $900.00, which was promptly cashed by Mr. Guarino.
  
  Mr. Guarino subsequently failed to either complete or even begin the job, failed to follow-through on any promises made, failed to provide any reliable start date, or to even return many subsequent telephone calls.
  
  I received no call-backs to any of several telephone calls I made to Joseph Guarino.
  
  We have never been able to recover our $900 deposit from Joseph Guarino of Melrose, or his company, J.A.G. Landscaping.”
